User License Agreement – StartBeFit v/Marcin Brocki

This User License Agreement ("Agreement") governs your access to and use of the StartBeFit website and mobile application, operated by StartBeFit v/Marcin Brocki. By accessing or using the platform, you agree to the terms and conditions set out below. If you do not agree, please discontinue use immediately.

1. License Grant

StartBeFit grants you a personal, non-exclusive, non-transferable, and revocable license to use the platform for private, non-commercial purposes. This license does not grant ownership of any software, database, or content. All rights not expressly granted are reserved by StartBeFit.

2. Prohibited Actions

You agree not to:

  • Copy, reproduce, or redistribute any content from the platform
  • Sell, share, or transfer your account to another individual
  • Take screenshots or record premium content for external use
  • Extract, reuse, or resell videos, images, or recipes for commercial purposes
  • Decompile, reverse-engineer, or attempt to bypass security systems
  • Use StartBeFit materials in your own training or business services
  • Upload or share illegal, offensive, or copyrighted materials without authorization

3. Intellectual Property

All materials on StartBeFit are protected by copyright and intellectual property law, including:

  • Workout plans, exercise descriptions, and training programs
  • Videos, graphics, and user interface elements
  • Recipes, images, and nutritional data
  • Website and app design, source code, and database structure
  • Logos, trademarks, and overall visual identity

Exercise graphics originate from licensed commercial-use digital assets purchased on Etsy. Recipes and food data are derived from the licensed CrawlFeeds Dataset. Users have no right to copy, sell, or redistribute this content outside the StartBeFit environment.

4. User-Generated Content

Any progress photos, measurements, or notes you upload remain your property. By uploading, you grant StartBeFit permission to store and process this data solely to provide account functionality. StartBeFit will never sell or share your personal data with third parties.

5. Automatic Translation

StartBeFit provides multilingual content through automated translation systems, including Google Translate API. These translations may contain inaccuracies. For all legal and contractual purposes, the English version is the official and legally binding version of all materials and documents.

6. Recipe Translation Disclaimer

Recipe titles, ingredients, and instructions may be automatically translated. Translation errors may lead to incorrect interpretation of ingredients or allergens. Users are responsible for verifying ingredients before use.

7. Termination

StartBeFit may suspend or permanently terminate your account if you violate this Agreement, including misuse, sharing of content, or fraudulent activity. Termination does not entitle you to refunds for any active subscription period.

8. No Warranty

The platform and all content are provided on an "as is" basis without warranties of any kind, express or implied. We do not guarantee uninterrupted operation, availability, or specific fitness results.

9. Limitation of Liability

To the maximum extent permitted by law, StartBeFit v/Marcin Brocki shall not be liable for any damages arising from or related to:

  • Injuries resulting from exercise or misuse of plans
  • Food allergies or ingredient intolerances
  • Errors or omissions in automated translations
  • Data loss caused by user devices or connectivity issues
  • Unauthorized use or sharing of content

10. Governing Law & Jurisdiction

This Agreement is governed by Danish law. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts of Vejle, Denmark.
